Artur the Roofer...or not

I had a report that Artur Machula's latest venture is as a roofer.
Back in October 2019 Artur took £350 for a job he didn't complete to replace some tiles on a Mr M's roof. Artur had previously brought a car from Mr M. Mr M got in contact with me to tell his story. Mr M said Artur was still using the 42 Woodford Green Road, Hall Green, Birmingham B28 8PL as address for both the car sale and the roofing job.

The car Mr M sold Artur's is not Artur's daily drive - a green Vauxhall Vectra KY53HCA, as pictured below outside number 42 Woodford Green Road, Hall Green, Birmingham B28 8PL at 0800 on 27/06/2020. Mr M. said despite being upset by the incident, he felt he had got away lightly given Artur's other deceptions.

Christmas at Arturs House

Apologies my last blog post was in in Draft for some time; I simply forgot to publish it.  Over Christmas I thought it may be a good opportunity to see if Artur was home.  On the 27th December I popped over and Artur's blue Freelander (actually its Magda's according to the debt collectors) was there.  I did consider knocking on his front door and wishing him a "Merry Christmas, oh and by the way where's my money?", but then I noticed someone had taken a blade to not one but all four of the tyres on the Artur's Freelander.  Given his physical threats against me last time we were in court I thought I'd give it a miss.

A quick look around told me no other cars in the street had been targeted.  Now that's not cool people!  Whilst Artur is paying for his new tyres, he has another excuse not to pay me any money 😂.  However this episode did make me look at this blog again and realise from the comments that Artur has not stopped his lies, scams and hurt on other people and that some of those people are not quite as mild mannered as myself.

Arturs Movements and Third Party Debt Orders

Its been a while since I've posted and seeing as its nearly Christmas I thought I would provide and update. To recap, Artur was ordered to pay £500/month and hasn't paid a penny.  So since then statutory interest is being applied.  At this point that's another £770.56 on top of what he owes.

In March I applied for a Third Party Debt Order.  You can find out more about those here.  I used the bank account details that Artur had provided for me to pay into, which turned out to be a Nationwide account.  Nationwide responded that he had several accounts, some of which were is joint names.  As the Third Party Debt Order cannot be applied to join accounts (unless all the individuals are on the CCJ) those could not be touched.

"We advise that we hold a further account in the joint names of the Defendant and another individual, therefore the Third Party Debt Order does not attach to that account."

Artur had two accounts at Nationwide, which totalled less than £5 credit.  So this wasn't going anywhere.

However we did get a court date and Artur Machula did turn up.  Artur was of course, raging about this web site and complaining to the judge that he could not work because of this site and hence he could pay me.  Of course the judge said that that was nothing to do with this hearing.  Outside the court I pointed out he wasn't paying me before the site went up, so there is no difference.  I then got threats of violence which are now a matter of record with the Police.

Its often claimed that Artur is not at the 42 Woodford Road address.  However most of the summer Artur's blue Freelander (which is owned by Magda apparently) seemed to spend plenty of time at the Woodford Green Road address. Here are a series of photos that show the vehicles was there and moving (thus being used) between 18th and 25th June.
18th June 07:05

19th June 06:44

20th June 17:43

25th June 07:32

On the 29th October Magada sent an e-mail saying that Artur had moved to an address 37 Bargate Drive, Wolverhampton, WV6 0QW. However when I sent a Signed For Special Delivery letter to that address it gets returned.

Failure to complete work in an unworkman like manner - Part 2

So in this part we'll look start to look at how Artur intended to lay bricks on the foundations that were incorrectly laid.
Artur's appointed brick layers had done ~1 day of laying bricks before leaving site and not returning.  I suspect they realise the foundations where in the wrong place as outlines in Part 1 of this and decided this was a job they did not want to be involved in.  But this was not until they had laid some bricks which actually overhang the foundations as shown in the photo below.  I think they thought that back filling around the bricks as they went would mean this would not be spotted.  But once inspection pits were dug it became clear what had happened.
Where these bricks are the wall would be 1m high so have a significant downward pressure and would have failed after a very short period of time.

All the information in this post was provided as part of the court case.

Failure to complete work in an unworkman like manner - Part 1

I didn't know a lot about foundations until I had to work with Artur.  All the following was provided during the court case.  To be fair to Artur, personally he did not actually do any work on site - he had got his "team" to do the work, but lets have a look at the first part of the failings - the spread of the foundations.  I found a good web site Paving Expert for information on foundations

Paving Expert says
Any footing should be at least 100mm wider on each edge than the thickness of the intended brickwork. So, for a 225mm thick wall, we will typically pour a 450mm wide footing. For load-bearing walls, the strip footing may be 600mm wide. The footing is typically 150mm thick, though this may be reduced to 100mm for smaller walls on good ground, or increased for heavier walls on bad ground.
What did I get?  The foundation was not even laid where the wall would go let alone provide a "spread" to support the wall.

Artur's Fails To Deliver Again

Of course its to be expected.  Artur Machula has yet again failed to do what the court ordered and has not paid the agreed £500.  Did he forget, well no.  As you can see below we had a conversation about it on the preceding Friday over text.  We had exchanged details outside the court room including account details and Artur's new mobile number.  I expected the "oh sorry I lost the details" story so sent the text on Friday to ensure he had the details.

By Tuesday I get a "I will pay on Saturday".  We all know how this is going to end right?

That's right, Artur did not pay so new proceedings in the post to the Court and £110 is added to Artur's outstanding costs.

Application to Vary Order

On the 5th Feb an Application to Vary Order was heard at Birmingham County Court. Artur had requested to pay just £100/month of the £12633.42 remaining on C4QZ9F36.  The judge ruled that he must pay £500/month from the 10th March 2018.

How to Complain About Editorial Content

As the very first blog article states, this blog has been created as a piece of journalism.  No trained journalist has been involved and the blog is in no way associated with the Independent Press Standards Office (IPSO); however the IPSO Editors Code of Practice rules seem a good set of rules as they govern many national newspapers both on and offline.

Note that actions in relation to the discovery of information for legal proceedings against Artur Macula or the recovery of money from Artur Macula are not covered by this Editors Code of Practice .

IPSO Editors Code of Practice provides a method of complaint.  This blog will attempt to follow the same process and rules.  Simply e-mail the site stating:
  • The IPSO ECoP Clause you are complaining under
  • Your complaint
Where complaining under Clause 1,2 or 10 please provide:
  • URL to the content
  • Extracts of the content deemed inaccurate
  • Evidence of accuracy
Any complaint received will then be responded to within 28 days.  Where a complaint is upheld a public apology will be made on the web site and content changed.

Van dumped

Artur Machula's van, FG51 TNU, has been parked on Fenton Way B27 6JY for some time.

Artur Machula's van on Fenton Way 24th July 2017

Its been there for some time and a quick check on the DVLA Vehicle Check web site, shows that its had
  • no Tax since 1st August 2017
  • no MOT since 21st June 2017

You'd suspect there was no insurance either.
The van was parked outside of a house for a bit No. 21 Fenton Way but then moved up the road out of the way.  This happened after the vehicle entered Untaxed status after which it should not have been on the road.  I wonder if Artur Machula has put in a SORN for it?  What really interesting is that at the time the vehicle move everyone was claiming that Artur had gone back to Poland; so who is moving the vehicle?

Artur's CCJs

So for the record here is Artur Machula's current list of CCJ as of August 2017:

Divorce for Artur and Magdelena

In the spring of 2017, Bailiffs chasing the debts owed by Artur Machula reported he has moved out of 42 Woodford Green Road, Hall Green, Birmingham B28 8PL and into a house of multiple occupancy 153 Douglas Road, Tysley, B27 6HJ

The Bailiffs were informed, as we understand it by Magdelena Jaza, that she and Artur are getting divorced.  As we know from previous record checks Artur has been in an out of the family household over the last few years, but its noticeable that this often occurs at time of Artur being financially in trouble.  Certainly in the early days of Magda Jaraza stating a divorce was in process, Artur's van (Blue Ford Transit FG51 TNU) could regularly be seen at the Woodford Green Road property so the divorce could be another diversion.  Both parties did repeated state they were getting a divorce.

However later it became clear that Artur was spending more time at 153 Douglas Road, because its where the Bailiffs actually found him.

Based on her LinkedIn profile Magdelena has three jobs on the go
  • Self employed Bookkeeper through Magdatax - Magda Association of Accounting Technicians AAT
  • Self employed Translator through Magdatax
  • Accounts Assistant at Pixel Toys a Leamington-Spa based games company

December 2016 New CCJ

On the 23rd of December 2016 at the Birmingham County Court, Civil Justice Centre and award of £13,602.07.  All the paperwork for the case was delivered to Artur Machula's home address of 42 Woodford Green Road, Hall Green, B28 8PL.  Artur did respond to some of the court paper work but on the day of the court proceedings Artur did not appear to make any defence against the core elements of the case:
  • The project was not completed within schedule and no credible plan provided
  • Failure to complete the work in a workmanlike manner

This make Artur's outstanding CCJs:
  • 3YQ61636 £18,444
  • C4QZ9F36 £13,602
That's a total of £32,046.

Artur Tomasz Machula

This is a site about Artur Tomasz Machula.  This site brings together public available information and links about Artur into one place so anyone about to do business with him can do so in full awareness.  Think of this as a bit of journalism.

Who is he?

To be in no doubt of which Artur Tomasz Machula we are talking about, its the following one:
Artur Tomasz Machula
  • Lives in a rented house on 42 Woodford Green Road, Hall Green, Birmingham and has been there since 2011 and before that he was in 412 Gospel Lane, B27 since 2006 with his wife.
  • Occasionally his first name is recorded as Arthur.  Deliberate or not, who knows, but this is a technique often used by Fraudsters.
  • Drives one of two blue Ford Transit vans (FG** TNU, B** PSZ) and occasionally an Audi A6 (FH** XXO)
  • His availability to comment on matters seems to suggest that he does not seem to just work in the Birmingham area but across the UK and, based on dial tones, abroad.
  • He claims to be a Plaster, Landscaper and sometime CPO (a what, yes CPO read below)

Artur Machula has had CCJs

Do you know how to search if someone has a CCJ?  Well here is the answer: Registry Trust.  It only cost £10 to search and could save you thousands.  On the May 23 2016 a search on Artur Macula shows an Unsatisfied Judgement.

According to Registry Trust this means:

Unsatisfied it indicates the status of the case as at the time the search was made. It does not necessarily indicate that the debt is unpaid either in whole or in part, but if it is fully paid Registry Trust Ltd has not been notified [Source]
Probably not best to give someone with a CCJ a large deposit for a job.

Artur Machula is subject to Bankruptcy Restriction Order

Artur is a discharged bankrupt, however he is still subject to a Bankruptcy Restriction Order or BRO until 2021.

If the official receiver feels that someone who is bankrupt has been dishonest, the court can make a bankruptcy restrictions order. [Source]

The restrictions are:

BRO and BRU restrictions include the rules you have to keep to when you are made bankrupt and other extra rules. For example, you must not:
  • act as a director of a company, or form, manage or promote a company, without permission from the court
  • carry on business under a different name without telling people you do business with the name (or trading style) in which you were made bankrupt
  • try to borrow more than £500 without saying you are subject to restrictions
  • be a trustee of a charity
  • work in various posts in education such as being a school governor [Source]
Normally a Bankrupt is only subject to these restrictions for a year.  Artur's BRO adds six years on so Artur must have been a very, very bad boy whilst he was a bankrupt. You can find details of Artur's BRO here on the Insolvency Register; isn't the internet brilliant.  If you ever want to complain to the Insolvency Service about someone who you think has broken their BRO then you can do that here.  If someone has broken a BRO then the Insolvency Service warns

It’s a criminal offence to break the restrictions - you might be prosecuted if you do.[Source]

Now Artur can't get credit at a supplier because of the BRO.  So he will struggle with his self employed building and landscaping business unless he can get deposits - and in my opinion that is risky for the customer.

Artur the Ex-Company Director

In the past Artur had a plastering company A M Plastering.  At one time Magdalena Jarza, who is Artur's wife was a director. A M Plastering was dissolved 09/2012.  This is about a year before the CCJ was registered.  I wonder why?
From Companies House

Artur the Close Protection Operative

The Close Protection Operative, or CPO, is an interesting one.  Artur claims on Facebook to have been trained at the Security College in Coventry and that seems to bear out.  His Facebook page also claims that he is SIA registered.

Now the SIA is responsible for the compulsory licensing of individuals working in specific sectors of the private security industry. The A quick check in the SIA Register will show no registration for anyone by the name of Machula.

There is a LinkedIn page for Artur too here which states a background in CP before he came to the UK in 2008.  However can't have been too successful as he seems to not have many connections and even less recommendations :-)
